These Terms of Use ("Terms") govern your access to and use of onboardability.com (the "Site"), operated by Onboardability, LLC ("Onboardability," "we," "us"), 2721 NW Thoreau Dr, Lee's Summit, MO 64081. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who this Site is for

The Site describes marketing and growth services that Onboardability provides to credit unions. It is intended for business use by credit union professionals and other interested organizations. The Site is not directed to consumers, and nothing on the Site is an offer of financial products or services to any individual.

Use of the Site

You may use the Site for lawful purposes and in accordance with these Terms. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any portion of the Site or its systems, scrape or harvest content or data by automated means without our written permission, misrepresent your identity or affiliation, or use the Site in any way that violates applicable law.

Interactive tools

The Site includes interactive tools, currently the Budget Benchmark, the Onboarding Assessment, and the Email Program Audit. These tools are provided for informational and educational purposes only. Results are generated from the inputs you provide and from published industry benchmarks, and they are estimates, not measurements. Benchmark figures describe a credit union's own budget planning ranges; they are not a quote, proposal, or estimate of Onboardability's fees, and they do not constitute pricing of any kind. Tool results are not a guarantee of any outcome, and you should not rely on them as the sole basis for any business decision.

No professional advice

Content on the Site, including articles, tools, benchmarks, and statistics, is general information. It is not financial, legal, accounting, or investment advice, and it does not create a client or advisory relationship. Decisions about your organization's budgets, programs, and strategy should be made with the advisors and information appropriate to your situation.

Information you submit

If you submit information through a form on the Site, you represent that the information is accurate and that you are authorized to provide it. Information you submit is handled as described in our Privacy Policy. Forms on the Site are intended for business contact information; please do not submit consumer account information or other sensitive personal data.

Intellectual property

The Site and its content, including text, graphics, logos, page designs, tool designs and scoring models, and underlying code, are owned by Onboardability or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive license to access and view the Site for your internal business purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit Site content without our prior written permission. Onboardability's name, logo, and related marks may not be used without our permission. Third-party names, marks, and product names that appear on the Site belong to their respective owners, and their appearance does not imply endorsement.

Limitation of liability

To the fullest extent permitted by law, Onboardability and its owners, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Onboardability and its owners, officers, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site in violation of these Terms or applicable law.

Governing law and venue

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Jackson County, Missouri, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent version. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
